  • The more serious the penalty group number and the larger the amount, the higher the range of punishment for the offense.
  • For example, the statutory punishment range for “PCS PG1 400G>” is 15-99 years.

Possession of Marijuana (POM): This only covers marijuana in the plant form, not any synthetics, wax, oils variations, or edibles.

  • State Jail Felony: More than four ounces to five pounds
  • Class A: More than two ounces to four ounces
  • Class B: two ounces or less
  • These are not taking into account any enhancements

Manufacturing & Delivery Charges

  • Based on the amount of drugs found, the packaging of the drugs when they were found, and/or various factors of how they were found could enhance a PCS charge into a manufacturing and delivery charge
