Possession of a Controlled Substance (PCS)

The “PG” seen in the Offense Charge refers to the “Penalty Group.” Different drugs fall into different groups. PG 1 is the most serious and PG 4 is the least.

Common PG 1 drugs are:

  • Cocaine
  • Heroin
  • Methamphetamine

Common PG 2 drugs are:

  • Synthetic THC
  • Ecstasy

Common PG 3 drugs are:

  • Ritalin
  • Xanax

Following the PG #, is the weight, usually in grams. Since it would be tedious to allocate a specific offense for each weight, they are broken into categories. The more serious the penalty group number and the larger the amount, the higher the range of punishment for the offense.

For example, the statutory punishment range for “PCS PG1 400G>” is 15-99 years.

Possession of Marijuana (POM)

POM only covers marijuana in the plant form, not any synthetics, wax, oils variations, or edibles.

  • State Jail Felony: More than four ounces to five pounds
  • Class A: More than two ounces to four ounces
  • Class B: two ounces or less

These are not taking into account any enhancements.

Manufacturing & Delivery Charges

Based on the amount of drugs found, the packaging of the drugs when they were found, and/or various factors of how they were found could enhance a PCS charge into a manufacturing and delivery charge.
